Terms of Service

These Terms govern your use of MixBound (the "Service"), operated by MixBound Pvt Ltd ("we", "us"). By creating an account, you ("Customer") agree to be bound by these Terms.

1 · What we provide

MixBound is a multi-tenant operational platform for marketing agencies serving appointment-based businesses. Subject to your subscription, we provide:

• Lead and pipeline management across your client tenants
• WhatsApp / SMS messaging via configured per-tenant credentials
• Payment processing via Razorpay (subscription + payment links)
• Compensation tracking and payout orchestration
• Compliance tooling for ASCI / DCI / IMA claim review
• Cohort-based practitioner training and certification

2 · Subscription & payment

Your fee is the tier amount plus per-tenant charges agreed at onboarding. Recurring charges run via Razorpay Subscriptions on a monthly cycle. GST is charged additionally at the prevailing rate.

We may halt the Service if a charge fails three consecutive retries (per Razorpay's mandate rules). Reactivation requires re-authenticating the mandate. Refunds for partial months are at our discretion.

3 · Your data

You retain ownership of all data you put into the Service (leads, conversations, configurations). We act as a Data Processor under DPDP Act 2023 with respect to data principals your tenants serve.

We will: (a) keep your data isolated by tenant via row-level security; (b) hold encrypted backups for at least 14 days locally and 90 days off-site; (c) export your full dataset on request within 7 working days; (d) delete your data within 30 days of subscription termination unless you request retention.

4 · Acceptable use

You must not:

• Send unsolicited marketing messages via the Service in violation of TRAI's regulations or Meta's WhatsApp Business Policy
• Make health, financial, or guaranteed-outcome claims that violate ASCI / DCI / IMA codes
• Use the Service to process data of EU residents without a separate GDPR Data Processing Addendum
• Reverse-engineer, scrape, or attempt to bypass tenant isolation
• Resell access to non-customer third parties (whitelabel arrangements require a written agreement)

We may suspend the Service for material breach with email notice. Repeated breach is grounds for termination.

5 · Availability & support

We target 99.5% monthly availability measured outside scheduled maintenance windows (which we announce in-app at least 24 hours ahead). Support runs Mon-Fri 10:00-19:00 IST via hello@mixboundmarketing.com. Critical issues (data loss, billing breach, security incident) get a same-day response 24/7.

6 · Liability

Our aggregate liability for any claim is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages. Nothing in these Terms excludes liability for fraud or gross negligence.

7 · Termination

You may cancel your subscription at any time from /agency-dashboard/subscription or by emailing hello@mixboundmarketing.com. Cancellation is effective at the end of the current billing cycle. We may terminate for material breach as described in §4.

8 · Governing law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

9 · Changes

We may update these Terms with 30 days' email notice. Continued use after the effective date constitutes acceptance.
